Terms of Service

These Terms of Service (“Terms”) govern your use of OmniAppHub at www.omniapphub.com and all of its subpages and applications (collectively, the “Site”). By accessing or using the Site you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Acceptance of these Terms

Your use of the Site constitutes your acceptance of these Terms and of the Privacy Policy, which is incorporated by reference. We may update these Terms from time to time; the most current version will always be posted at this URL, and the “Last updated” date will be revised. Continued use of the Site after a change takes effect constitutes acceptance of the revised Terms.

2. Age requirement

The Site is intended for users aged thirteen (13) and older. If you are under thirteen, you may not use the Site. Children may interact with apps such as Family Chore & Reward Tracker only under the direct supervision of a parent or legal guardian, and the parent or guardian is responsible for that use. If you are between thirteen (13) and the age of legal majority in your jurisdiction, you represent that you have your parent's or guardian's permission to use the Site.

3. Acceptable use

OmniAppHub is offered for personal, non-commercial educational and entertainment use. You agree not to:

• Use the Site for any unlawful purpose or in a manner that infringes the rights of others;
• Attempt to interfere with, probe, or disrupt the Site's infrastructure, including but not limited to denial-of-service attempts, port scanning, or attempts to bypass rate limits or security controls;
• Use automated scripts, bots, crawlers, or scrapers to access the Site in volumes or at rates that materially exceed normal human browsing, except for well-behaved search-engine crawlers that respect robots.txt;
• Reverse-engineer, decompile, or attempt to extract the source code of any part of the Site beyond what is permitted by applicable law;
• Mirror, frame, or redistribute the Site or any portion of it in a manner that misrepresents its origin or strips its branding;
• Click on, generate impressions of, or otherwise interact with advertisements in a manner that violates the terms of the advertising networks serving those ads, including Google AdSense's program policies;
• Upload, transmit, or store on the Site any content that is illegal, defamatory, harassing, hateful, or sexually explicit, or that contains malware.

We may suspend, restrict, or terminate access for any user who violates these rules, with or without notice, at our sole discretion.

4. Intellectual property

All original content on the Site — including text, graphics, layout, user-interface design, and source code — is owned by OmniAppHub or its licensors and is protected by United States and international copyright laws. You may view and locally cache pages of the Site for personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works of, publicly display, or publicly perform any portion of the Site without our prior written permission, except as permitted by applicable fair-use or fair-dealing law.

Third-party trademarks and brand names mentioned on the Site, if any, are the property of their respective owners and are used for descriptive purposes only.

5. User-generated content stored on your device

Several apps on the Site let you enter your own content — for example, custom chore names or score history. This content is stored in your browser's local storage on your device and is not transmitted to us. You retain all rights to it. You are responsible for backing up any such content; we cannot recover data that is lost because you cleared your browser, switched devices, or used the Site in private-browsing mode.

6. Third-party content and links

The Site displays advertisements served by third-party advertising networks, including Google AdSense, and may link to third-party websites. We do not endorse, control, or assume responsibility for any third-party content, products, or services. Your interactions with any advertiser or linked website are solely between you and that third party.

7. Disclaimer of warranties

THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, NOR DO WE WARRANT THAT ANY EDUCATIONAL OR ENTERTAINMENT GOAL — INCLUDING IMPROVED CHESS COORDINATES, MATH FLUENCY, PITCH RECOGNITION, OR PROGRAMMING SKILL — WILL BE ACHIEVED BY USING IT. EDUCATIONAL CONTENT IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND IS NOT A SUBSTITUTE FOR PROFESSIONAL INSTRUCTION.

8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL OMNIAPPHUB, ITS OPERATORS, OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SITE — WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE. TO THE EXTENT THE FOREGOING LIMITATION IS HELD UNENFORCEABLE, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SITE SHALL NOT EXCEED ONE HUNDRED UNITED STATES DOLLARS (US $100), OR THE AMOUNT YOU PAID US TO USE THE SITE IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so portions of the above may not apply to you.

9. Indemnification

You agree to defend, indemnify, and hold harmless OmniAppHub and its operators from and against any claim, liability, loss, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or the rights of a third party.

10. Termination

We reserve the right to suspend or terminate your access to the Site at any time, with or without cause and with or without notice. Sections that by their nature should survive termination — including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law — will survive.

11. Governing law and dispute resolution

These Terms are governed by, and shall be construed in accordance with, the laws of the United States of America and, to the extent applicable, the laws of the state in which the Site is operated, in each case without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located within the United States, and you consent to the personal jurisdiction of those courts. Nothing in this section prevents either party from seeking injunctive or equitable relief in any court of competent jurisdiction.

12. Severability and entire agreement

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and OmniAppHub with respect to the Site and supersede any prior agreements on the same subject matter.
